Yoga Retreat Terms & Conditions*

Upon completing your reservation, you hereby agree to the following terms and conditions as stated by Pa'lante Yoga.

 

1. BOOKING

(a) Your booking is not considered definite and no contract will exist until we receive a $500 deposit from you and you agree to these terms and conditions.

(b) We do not share customer details with any 3rd parties.

 

2. PAYMENT

(a) The price is the exact amount to be received by us in US Dollars.

(b) A $500 deposit + 3% PayPal transaction fee is due within 48 hours of confirmation by Pa’lante Yoga to secure reservation.

(c) The full payment amount is due by date listed on invoice + retreat landing page. If the full amount is not paid on time, the reservation will be forfeited.

(d) All payments should be made via PayPal to hola@palanteyoga.com

(e) Payment via check or Zelle available upon request

 

3. YOUR TRAVEL ARRANGEMENTS

All flight arrangements + airport transfers are your responsibility and at your own cost. We shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel. Only transportation specified in the retreat description shall be provided by Pa’lante Yoga.

4. TRAVEL INSURANCE

Travel insurance is highly recommended. After COVID, it may even be required by your airline. You are responsible for researching this before your flight. If you choose to buy insurance we suggest that your travel insurance covers the activity of this retreat as well as unexpected cancellation, sickness, losses and all the usual risks. You should bring the policy with you in case of an emergency.

5. COVID-19 travel policies

It is your responsibility to comply with all COVID-19 rules and regulations in accordance with travel restrictions. As restrictions from both the outbound and inbound countries evolve, it is your responsibility to comply. This may include proof of negative COVID tests, vaccinations, insurance, etc. Please confirm the embassy website of both inbound and outbound countries for more details.

6. YOUR HEALTH

(a) It is your responsibility to let the instructors of Pa’lante Yoga know if you have any injuries and to be mindful at all times of your own body’s capability during the retreat. If you experience any injury or discomfort during any activity during the retreat, then you must desist immediately.

(b) It is also your responsibility to consult a doctor with an understanding of yoga to check that you are sufficiently fit and healthy to undertake yoga classes and other physical activities that you may chose to do whilst on the retreat.

(c) Please advise us of any mental or physical health conditions and dietary requirements before you book. If you have health conditions and dietary requirements that may be affected by the activities offered on our retreats we reserve the right to advise you to desist and in the interests of your wellbeing, or others, we may decline your stay at our retreats

(e) Because of the potential for mosquitos, and therefore Zica, we ask that you do not attend the retreat if you are expecting or plan to get pregnant soon after the retreat.

(f) By attending a retreat, you understand that you may be exposed to COVID at any time via travel or throughout the stay. Pa’lante Yoga is not responsible for any illness or death, resulting from COVID during the yoga retreat.

 

7. CANCELLATION BY YOU

(a) Deposits are non-refundable due to cancellation by guest.* If you are unable to attend the retreat due to a health or family emergency, please communicate that with us as soon as possible to see if special accommodations may be made, although not guaranteed.

*If we are able to find a replacement for your space on the retreat, we would be happy to issue you a refund.

(b) Bookings are for the stated period of the retreat. There are no refunds for an unused portion of the retreat. If the reason for cancellation is covered under the terms of your Insurance Policy, you may be able to make a claim on your insurance.

 

8. AMENDMENTS BY US

Occasionally, changes may have to be made (e.g., retreat staff, meals, excursions, or other arrangements), which we reserve the right to do at any time. If your accommodation has to be changed, we will do our utmost to provide accommodation of a similar rating. If a significant change becomes necessary, we will inform you as soon as reasonably possible if there is time before your departure.

 

9. CANCELLATION BY US

Pa’lante Yoga reserves the right to cancel without liability if the group cannot meet because of significant physical changes to the retreat destination caused by acts of god, war, global crisis (i.e. pandemic), and venue issues (i.e. venue damage, fire, change of ownership, or resort or labor strikes). Pa’lante Yoga reserves the right to cancel any retreat in case of force major. In this event, no refund is possible. Pa’lante Yoga is not responsible for any expenses or damages incurred as a result of event cancellation including preparation costs, airline tickets, travel documents, or other expenses. Travel insurance is always recommended. All monies related to outstanding services that could not be performed on the retreat as a result of a force majeur event will be credited to the retreat guest to be used within 18 months following the cancellation notice. The credit is personal to the retreat gust and is neither sellable or transferable to any other party. In case of force majeur during a retreat, Pa’lante Yoga will take the best course of action to keep all guests safe as decided by management. This may include emergency evacuation and cancellation of the event. All monies associated with room and food costs in an instance of evacuation will be covered by the guests.

 

10. OUR LIABILITY TO YOU

(a) We accept responsibility for ensuring that the retreats are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.

(b) We do not accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, pandemic, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond our control.

(c) We are not liable for any injuries you may incur. Yoga classes and other physical activities are undertaken at your own risk. We are not liable for any medical or psychiatric conditions, which may develop during or subsequent to the retreat. We are not liable for loss of, or damage to, your personal property.

 

11. GROUP BOOKINGS

Where a booking is made on behalf of several individuals the booking is conditional on the person(s) paying having authorization from all the individuals named on the booking form to enter into this contract. The terms of this contract will apply to each member of the group as though they had paid for their own retreat individually and directly to us.

 

12. NO LIABILITY FOR POSSESSIONS

It is your responsibility to ensure that your possessions are kept safe at all times. Pa’lante Yoga does not accept responsibility for any lost or stolen items, including passport, luggage, wallet, etc.

13. DRUGS AND ALCOHOL

Drugs and alcohol will not be permitted at the retreat space at any time in order to create a safe space for all guests. Drugs will not be allowed at any time during the retreat and we ask that alcohol be limited to moderate amounts when off-site, in your free time. If you are unable to follow these guidelines, we remain the right to dismiss you from the retreat at any time. This retreat is not geared to be a detox for those who have substance addiction. 14. HOUSE RULES

You will be provided with a set of general house rules (as requested by the home owner) before the retreat begins. Additionally, we ask that no other guests be brought back to our retreat space. Only paying customers who are attending the retreat will be permitted to enter the retreat space. If you are unable to follow this rule, you will be dismissed from the retreat immediately, as will your unsolicited guest.

15. COMPLAINTS

If you have a problem during your retreat, please inform the organizer immediately and he/she will endeavor to put things right. Please note that we cannot be responsible for the individual behavior of any group member or other guest sharing your accommodation.

 

16. PRIVACY POLICY

We do not share customer details with any 3rd parties. Any personal information that you provide to us will be used only for the service you requested. This information is used only for administration of the site system and in the compilation of statistics used by us to assess the use of the site. This privacy policy does not cover the links within this site linking to other sites.

 

17. PHOTOGRAPHY

I hereby acknowledged, hereby irrevocably authorize Pa’lante Yoga & Affiliate Photographers to use photographs of me and or my property and authorize her and her assignees, licensees, legal representatives and transferees to use and publish (with or without my name) photographs, pictures, portraits or images in any and all forms and media and in all manners including composite images or distorted representations, and the purposes of publicity, illustration, commercial art, advertising, publishing (including publishing in electronic form on CDs or internet websites), for any product or services, or other lawful uses as may be determined by the photographer or studio name here. I further waive any and all rights to review or approve any uses of the images, any written copy or finished product. I am of full legal age and have read and fully understand the terms of this release.

YOGA SPECIFIC TERMS AND CONDITIONS

I understand that yoga requires and includes physical movements. I realize that yoga also provide relaxation, stress relief, stress education and awareness. As with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will notify the instructor, adjust my posture and listen to my body. I will not push my body too far and will ask for support from the teacher if needed.

Yoga is not a substitute for medical care or diagnosis. Yoga can work well in conjunction with traditional medical care. I will practice yoga only after discussing it with my doctor and gaining their approval. I affirm that I alone am responsible to decide whether to practice yoga. I hereby agree to irrevocably release and waive any claims that I have now or hereafter may have against Pa'lante Yoga. 

 

I, hereby agree to the following:

1. That I am participating in yoga classes offered by Pa’lante Yoga affiliated instructors, where I will receive information and instruction about yoga. I understand that yoga requires physical exertion which may be strenuous and may be strenuous and may cause physical injury. I am fully aware of the risks involved.

2. I understand that it is my responsibility to consult with a physician prior to and in reference to my participation in yoga classes. I warrant and represent that I am physically fit and have no medical condition that would prevent my full participation in yoga.

3. In consideration of participating in yoga, I agree to assume full responsibility for any risks, injury or damages, which I might incur as a result in participating yoga.

4. I knowingly and voluntarily waive any claim I might have against Pa’lante Yoga for injury or damages that I may sustain as a result of participating in this program.

5. I, my heirs or legal representative forever release, waive, discharge and covenant not to sue Pa’lante Yoga or affiliated instructors for any injury or death caused by their negligence or other acts.
